Birthday Club & Giveaway Official Rules

The Sunny the Panda Birthday Club, giveaways and challenges are sponsored by Noise Media Network, doing business as Sunny the Panda (“Sponsor”), located at 5435 Sugarloaf Parkway, Ste. 2201, Lawrenceville, GA 30043. Questions may be sent to Support@noisemedia.us.

NO PURCHASE OR PAYMENT IS NECESSARY TO JOIN THE SUNNY THE PANDA BIRTHDAY CLUB OR ENTER OR WIN A GIVEAWAY. A PURCHASE WILL NOT INCREASE THE CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

The Sunny the Panda Birthday Club is created for children ages 4 through 8, but a child may not register, submit an entry or provide personal information independently.

All registrations and entries must be completed by the child's parent or legal guardian, who must be at least 18 years old and a legal resident of one of the 50 United States or the District of Columbia.

By submitting an entry, the adult confirms that: they are the participating child's parent or legal guardian; they have authority to provide the submitted information; the child meets the age requirements for the applicable promotion; and they have read and agreed to these Official Rules.

Employees, contractors and immediate family members of the Sponsor are not eligible to win.

Membership in the Sunny the Panda Birthday Club is free. A parent or legal guardian may enroll an eligible child by completing the official registration form.

The form may request the parent's name, email address, mailing location, the child's first name or nickname, age and birthday month and day. Parents should not provide more information than the form requests.

Joining the Birthday Club does not guarantee that a child will receive a gift, prize, birthday message or public recognition. Birthday Club members may become eligible for birthday drawings, activities and special announcements as described in each promotion.

A parent may request removal from the Birthday Club or deletion of the child's submitted information by contacting Support@noisemedia.us.

Each giveaway will have a stated opening date, closing date and time. Entries must be received before the announced deadline.

Unless a giveaway announcement states otherwise, all deadlines are based on Eastern Time. The Sponsor's system will serve as the official timekeeper.

Entries submitted before or after the announced entry period will not be eligible.

A parent or legal guardian must complete the official entry form located on this website and follow the instructions for the applicable giveaway or challenge.

Limit one entry per eligible child per giveaway unless the specific giveaway announcement permits otherwise. Automated, duplicate, incomplete, altered or fraudulent entries may be disqualified.

No entry may require a purchase, paid membership, donation or other payment.

For a birthday-themed drawing, the child must be between the ages of 4 and 8 at the time of entry; have a birthday during the month or eligibility period identified in the giveaway announcement; be entered by a parent or legal guardian; and meet any additional requirements stated in the giveaway announcement.

The Sponsor may request reasonable age and eligibility verification from the parent before awarding a prize.

Sunny the Panda challenges may be conducted as participation activities, random giveaways or skill-based contests. The applicable challenge announcement will explain how recipients are selected.

For a skill-based challenge, entries may be evaluated using announced criteria such as creativity, effort, originality, connection to the challenge theme, age-appropriate presentation and following the challenge instructions.

The judges' decisions are final. Chance will not determine the outcome of a skill-based contest.

For a random giveaway, the potential recipient will be selected randomly from all eligible entries received during the stated entry period.

All artwork, photographs, videos, recordings or written materials must be submitted by a parent or legal guardian.

The parent confirms that the submission was created by or features their child with permission; does not violate another person's copyright, trademark, privacy or other rights; does not contain unsafe, inappropriate, hateful or unlawful material; does not reveal private information such as a home address, school name, telephone number or precise location; and does not feature another child unless that child's parent or legal guardian has provided permission.

The Sponsor may reject or remove any submission that does not meet these requirements.

Submitting an entry does not automatically give the Sponsor permission to publicly display the child's name, image, voice or submission. Any public display or promotional use involving a child will require the parent's separate permission.

Potential recipients will be selected according to the method and approximate date stated in the applicable giveaway announcement.

For random drawings, the odds of receiving a prize depend on the number of eligible entries received.

A potential recipient is not an official winner until the parent's eligibility has been verified, all required forms have been completed and the Sponsor has confirmed the award.

The Sponsor will contact the selected child's parent or legal guardian using the contact information provided on the entry form.

The parent may be required to respond within five calendar days and complete an eligibility confirmation, parental consent form, liability release, prize acceptance form or shipping form.

If the parent does not respond within the stated time, cannot be contacted, declines the prize, provides inaccurate information, or fails to complete the required documentation, the prize may be forfeited and an alternate recipient may be selected.

Children will not be contacted directly.

The prize, quantity and approximate retail value will be identified in each giveaway announcement.

For the Sunny Birthday Toy Chest Giveaway, the anticipated prize is one customized Sunny the Panda toy chest. The approximate retail value will be stated in the giveaway announcement. Final colors, artwork, materials, size and design may vary from promotional images.

Prizes cannot be transferred, redeemed for cash or exchanged unless the Sponsor decides otherwise. The Sponsor may substitute a prize with another prize of equal or greater value if the advertised prize becomes unavailable.

The parent is responsible for any federal, state or local taxes associated with receiving the prize.

If a prize will include the child's photograph, the Sponsor will request the image from the parent or legal guardian through an approved submission method.

The parent authorizes the Sponsor and its approved production providers to use the submitted photograph solely to create and deliver the personalized prize, unless the parent separately agrees to broader promotional use.

Photographs collected only for prize customization will not be posted publicly without separate parental permission and will be retained only as long as reasonably necessary to produce, deliver and document the prize.

If a parent does not wish to provide a photograph, the Sponsor may, at its discretion, offer a name-only or non-photographic version of the prize.

Accepting a prize does not automatically require a parent to permit public use of the child's image, name, voice or likeness, except where legally permitted and specifically disclosed.

If the Sponsor wishes to feature a child or submission on its website, social media, videos, advertising or promotional materials, the parent will receive a separate publicity authorization describing the proposed use.

Declining optional publicity permission will not affect the child's eligibility to receive an awarded prize.

The Sponsor will collect, use, store and delete personal information according to the Sunny the Panda Privacy Policy and applicable children's privacy laws.

Information submitted for Birthday Club participation, challenges or giveaways will be used to administer memberships, entries and promotions; verify eligibility; communicate with parents or legal guardians; create and deliver prizes; maintain legally required records; and prevent fraud or misuse.

The Sponsor will not knowingly ask children to submit personal information directly. Parents may request access to, correction of or deletion of their child's information by contacting Support@noisemedia.us.

Personal information will not be retained longer than reasonably necessary for the stated purpose, subject to applicable legal and recordkeeping requirements.

The Sponsor may disqualify any entrant who violates these Official Rules; attempts to manipulate or interfere with a promotion; submits false, misleading or unauthorized information; harasses another participant or Sponsor representative; or uses automated or fraudulent entry methods.

If fraud, technical problems, unauthorized intervention or circumstances beyond the Sponsor's reasonable control affect a promotion, the Sponsor may suspend, modify or cancel it and select recipients fairly from eligible entries received before the interruption.

The Sponsor's decisions concerning eligibility, administration and interpretation of these rules are final, subject to applicable law.

To the fullest extent permitted by law, participating parents and legal guardians agree to release the Sponsor and its owners, employees, contractors, vendors and representatives from claims arising from participation in a promotion or the acceptance, possession or use of a prize, except for claims that cannot legally be waived.

The Sponsor is not responsible for lost, late, incomplete, misdirected or technically corrupted entries; internet or equipment failures; incorrect contact information; shipping delays; or damage caused by carriers or circumstances outside the Sponsor's reasonable control.

Nothing in these rules limits rights or remedies that cannot be limited under applicable law.

Unless a giveaway announcement expressly states otherwise, Sunny the Panda promotions are not sponsored, endorsed, administered by or associated with Facebook, Instagram, TikTok, YouTube, Pinterest or any other social media platform.

Entrants release the applicable platform from responsibility for the promotion to the extent permitted by law. Questions should be directed to the Sponsor, not the social media platform.

These Official Rules are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute will be handled in a court of competent jurisdiction located in Gwinnett County, Georgia, except where applicable law provides otherwise.

Each giveaway announcement should identify the promotion name; opening and closing dates; eligible ages and locations; entry instructions; entry limit; selection method; selection and notification date; prize description; approximate retail value; number of prizes; and Sponsor contact information.

If specific giveaway terms conflict with these general rules, the specific terms will control for that giveaway, unless prohibited by law.
